By accessing alyverx.com ("Website") or using our services ("Services"), you agree to these Terms of Use ("Terms"). If you do not agree, you must not use the Services.

2. Age & Eligibility

You must be 18 years of age or older and located in a state where AlyveRx operates. You must provide accurate and complete information to access our Services.

3. Telehealth Services & Provider Relationship

AlyveRx is a technology platform that facilitates telehealth services delivered by independent, licensed medical providers ("Providers") through affiliated medical groups.

AlyveRx does NOT provide medical care and does not practice medicine. Providers independently determine whether telehealth is appropriate and may decline to provide treatment or prescriptions at their sole discretion.

4. Not for Emergencies

⚠ The Services are NOT for medical emergencies. If you are experiencing a medical emergency, call 911 immediately or go to your nearest emergency room.

5. Prescriptions & Limitations

Providers may prescribe medications when medically appropriate. AlyveRx and affiliated Providers do not prescribe controlled substances or medications prohibited by federal or state law.

6. User Responsibilities

By using the Services, you agree to:

Provide truthful, accurate, and complete information at all times
Use the Services legally and in a respectful manner
Not attempt to hack, disrupt, or misuse the platform
Not impersonate another person or entity
Not use the Services for fraudulent or unlawful purposes

7. Payments & Refunds

If paid services are offered:

You agree to pay all fees associated with your use of the Services
Subscription services renew automatically unless cancelled prior to the renewal date
Refunds are issued only in accordance with our posted refund policies

8. Intellectual Property

All content, branding, software, design, and materials on the Website are the property of AlyveRx, LLC. You may not copy, distribute, modify, reproduce, or exploit any content without prior written consent.

9. Third-Party Services

We may link to or integrate third-party services, including labs, pharmacies, providers, and other tools. AlyveRx is not responsible for the content, actions, policies, or reliability of any third-party services.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee medical outcomes, treatment results, or platform availability.

11. Limitation of Liability

To the fullest extent permitted by applicable law, AlyveRx is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or data, arising from your use of the Services.

12. Indemnification

You agree to indemnify, defend, and hold harmless AlyveRx, LLC, its affiliated medical groups, Providers, officers, employees, and agents from any claims, liabilities, damages, or costs arising from your misuse of the Services or violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Disputes arising under these Terms will be resolved through binding arbitration, unless prohibited by applicable law.

14. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with the updated effective date. Your continued use of the Services following any update constitutes acceptance of the revised Terms.
